Extractive
“The extractive industry is complex and often gives rise to environmental and planning issues; effective management is crucial to a successful operation. We understand how the industry operates and our expertise allows us to identify issues from the outset, placing our clients in the best position to achieve their goals with minimum risk and maximum benefit.”
Levent Shevki, Partner and Head of Extractive
Services and Expertise
Cornwall Stodart has over 40 years' experience in the extractive
and waste management industries, and is widely recognised for its
expertise in these areas.
Our clients indicate the diversity of the industry and range
from quarry operators, concrete plants, landfill operators, waste
collection companies, and mining and resources companies.
We regularly advise clients on mergers and acquisitions,
dispositions, workplace relations, occupational health and safety,
corporate matters, commercial contracts, dispute resolution,
property and leasing, planning matters, environmental issues and
taxation.
Our experience is generally related to both operational and
enforcement issues and their connection with the law, in particular
the Mineral Resources (Sustainable Development) Act
1990 (previously the Extractive Industries
Development Act 1995), the Planning and Environment Act
1987, the Aboriginal Heritage Act 2006 and the
Environmental Protection and Biodiversity Conservation Act
1999. For example, we recently advised a client on
issues surrounding use and development permits.
More recently we have focused our attention on issues regarding
the merger of the Extractive Industries Act 1995 and the
Mineral Resources (Sustainable Development) Act 1990. The
merger came into effect on 1 January 2010 and is creating some
transitional issues.
Along with the legislation, we are also up to date with the VCAT
planning and environment practice notes and represent and act for
our clients in VCAT.
