Andrew has over 20 years' experience advising and acting in complex
commercial litigation. Over the last 15 years he has advised
and acted in a wide variety of matters involving intellectual
property rights including patents, registered designs, copyright
and trade marks and misleading and deceptive conduct.
In addition to matters involving registered IP rights, Andrew has
significant experience in general contractual disputes and the
protection of trade secrets and confidential information. He has
advised and acted for clients in a number of matters involving
allegations of breach of confidence and the misuse of confidential
information.
Andrew has worked with and for clients in a diverse range of fields
and technologies including agriculture, mining and resources,
insurance, heavy transport manufacturing, precision engineering,
automotive, electrical and electronic industries, retail, food and
confectionary, clothing and fashion, furniture design and
manufacture and fine arts.
Andrew was named in the Intellectual Property Law list of the
Australian Financial Review's Best Lawyers in Australia in 2011,
2012, 2013 and 2014.
Experience
Andrew's experience includes:
• advising and acting for a heavy transport
manufacturer in Federal Court proceedings for infringement of
copyright in its technical drawings and the misuse of its
confidential information by a competitor;
• representing a clothing manufacturer in relation to
alleged copyright infringement arising out of the manufacture and
sale of clothing closely resembling a major competitor's clothing
designs;
• acting for a designer and manufacturer of automotive
lighting systems in Federal Court proceedings to protect its
registered design rights from infringement by a competitor
which had copied and put on sale an almost identical aftermarket
lighting product;
• acting for a well-known local fashion design house
in proceedings to protect its trade marks from infringement and
from a competitor passing off its goods as those of my
client;
• acting in trade mark validity and revocation
proceedings for a US client - particularly involving allegations of
'bad faith' by the opposing trade mark applicant.;
• advising and acting for a German client in the
(successful) defence of claims of patent infringement arising out
of the client's development of complex signal processing
technology;
• advising a local lighting system designer in the
protection of its confidential client and design related
information following the sudden departure of two employees who
then commenced operating a competing business;
• advising a resources client in relation to
licensing, trade secrets, registered designs and other IP rights
for the client's development of a heavy vehicle tyre re-treading
facility in WA - using heavy machinery to be imported from Italy,
and employing patented German technology and French designs and
patterns to produce re-moulded heavy transport tyres for mining
equipment; and
• advising both local and US furniture industry clients in relation
to the protection available to them under various registered trade
marks and designs in the face of competing activity within
Australia that infringed those TM and design rights;

Service.
He is also involved in both fund raising activities for and as a
regular donor to a number of international and local charitable
