Expertise

Clare provides advice, support and assistance to a variety of clients, ranging from individuals to small to medium sized enterprises and national companies.

She advises on various employment and industrial relations issues, particularly regarding the terms and conditions of employment (whether contained in standard employment contracts, enterprise agreements or industrial awards) and how these can be best managed. This has included undertaking detailed compliance programs for large national companies and developing a strategy for growth with the employer.

Clare regularly drafts contracts, agreements and employment policies and procedures, as well as providing general and bespoke training and update sessions for clients. She also provides corporate support when clients wish to buy or sell their businesses.

In addition, she handles employment related litigation, including health and safety prosecutions, dismissal, discrimination and breach of contract.

Experience

Clare's recent experience includes:

  • representing an employer in a prosecution brought by WorkSafe for breach of the Victorian Occupational Health and Safety Act
  • advising on disciplinary processes and dismissal procedures
  • drafting an enterprise agreement for an employer with employees engaged in various occupations, including social work, retail, administration and management. The agreement displaced several awards and included many different pay scales, all of which contributed to the complexity of drafting and negotiating the agreement with the Union
  • conducting a thorough review of and training on the award modernisation process, including its impact on current terms and conditions of employment and how the transitional provisions will affect pay scales
  • advising a national retailer on the terms of an outsourcing agreement and the impact of the transfer of business provisions in relevant legislation.

Clare has advised and represented individuals through participation with the Free Representation Unit in London.
