Mark has long combined his work as an academic teacher and researcher with an active role as a senior consultant solicitor, working mainly in the fields of commercial litigation and government liability.

Widely recognised within the Australian legal profession for his expertise in government torts and for judicial review of bureaucratic and regulatory action, Mark is honoured by the publication of a Festschrift, Administrative Law in a Changing State.

Throughout the years Mark has been a consultant to government law reform commissions on a number of projects at Commonwealth and State level in Australia, and to the Law Commission of England and Wales. He has also served as the senior policy advisor to the Attorney General for New South Wales for three years.

Mark is delighted to work with Cornwalls as a Senior Consultant and enjoys being of service to the wider legal community.

Experience

The University of New South Wales made Mark an Emeritus Professor of Law, following his formal ‘retirement’ from that Faculty. However, Mark continues to work there, supervising and examining PhD candidates, and publishing his ongoing research.

As a Visiting Fellow, Mark recently taught a specialist course on government liability at the University of Melbourne’s masters program. Mark has also held Visiting Fellowships at the London School of Economics and the University of Oxford.

In addition, Mark has been published widely and has been a speaker at conferences in Australia, the United Kingdom and Canada. His research interests have spanned several areas of the law, including civil and criminal procedure, the law of evidence and its partial codification, the tort liability of government and other public authorities, and administrative law. Mark has also co-authored Judicial Review of Administrative Action and Government Liability (Thomson Reuters, Sydney, 2017), which is currently in its 6th edition and is the leading Australian treatise on the subject.

Pro Bono And Community Work

Mark’s work for Law Reform Commissions has always been pro bono, and he has occasionally advised or acted pro bono in test cases.
