Tooba Khaliqy

Tooba specialises in dispute resolution and commercial litigation and has vast experience acting for a range of corporate and individual clients in the state and federal courts.

Tooba’s practice encompasses a broad range of commercial disputes, including contractual disputes, claims under the ACL, shareholder and partnership disputes, Corporations Act matters and trust disputes.

Tooba thrives on the intellectual challenge of commercial disputes and takes pride in her detail oriented and solution focused approach. She finds it particularly rewarding to guide clients through difficult disputes, helping them navigate uncertainty with clarity and confidence.

Tooba’s recent experience includes:

• acting for three unitholders in Supreme Court of Victoria proceedings seeking orders for the removal of the trustee of the unit trust and an interlocutory injunction restraining the trustee from accessing trust funds
• acting for a national laboratory in proceedings issued against it in the Supreme Court of Victoria in respect of allegations of breach of contract and misleading and deceptive conduct
• acting for beneficiaries of a family trust in County Court of Victoria proceedings against the trustee seeking orders for the payment of unpaid present entitlements
• acting on behalf of thirteen individuals and an interested party in an application to the Administrative Appeals Tribunal for review of decisions made in respect of Fair Entitlements Guarantee claims
• acting for a minority shareholder in respect of a dispute relating to shareholder oppression and breaches of directors’ duties
• acting for two individuals in Supreme Court of Victoria proceedings in respect of a complex family trust dispute in relation to the family business and an $8M commercial property

Tooba previously undertook a secondment with JobWatch providing advice to vulnerable individuals in respect of a broad range of workplace issues including unfair dismissal, adverse action and underpayment of wages, superannuation and other entitlements.
