Daniele specialises in commercial litigation and insolvency with a particular emphasis on fraud, regulatory compliance and breaches of the Corporations Act.

Daniele has experience in most civil jurisdictions in Australia and often acts for clients seeking urgent relief from the Court, including obtaining freezing orders or other injunctive relief. She regularly represents clients in both pre-litigation and court ordered mediations.

Daniele’s commercial litigation practice involves a broad range of commercial disputes, including breaches of contract, property and leasing disputes and shareholder oppression actions.

Daniele regularly advises insolvency practitioners in all aspects of voluntary administrations, receiverships, liquidations, including issuing and defending court proceedings.

Experience

Daniele’s recent experience includes:

  • Acting for an insurance company in relation to the misappropriation of $17 million by its employee including obtaining Anton Piller orders, freezing orders and recovering assets.
  • Advising directors and companies regarding their obligations under the Corporations Act in connection with director disputes, shareholder oppression proceeding and claims for breaches of directors’ duties and other fiduciary obligations.
  • Acting as an independent solicitor to supervise the service and execution of Anton Piller orders.
  • Acting for liquidators to conduct public examinations and issuing recovery proceedings.
